The InMyTeam patient data sharing Site (“Site” or the “Service”), operated by InMyTeam Corp. (“InMyTeam” or “Company”), serves as a collaborative platform designed for healthcare professionals, agencies and their staff members (collectively, “you” or “User”). Through the Agency Portal, the Company facilitates the efficient coordination of healthcare and caregiving services by allowing agencies and healthcare professionals to create, manage, and assign case listings to appropriate staff members, ensuring seamless service delivery in the healthcare sector. The portal is equipped with features to enhance communication and manage essential documents, fostering a productive environment for all users involved in the healthcare service provision process.

 

By accessing and using this Service, you signify that you have read, understood, and agree to the Site privacy policy (“Privacy Policy”). We reserve the right, at our sole discretion, to change, modify, add, or delete portions of this Privacy Policy at any time without further notice. If we do this, we will post the changes to this Privacy Policy on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of the Service after any such changes constitutes your acceptance of the new terms of this Privacy Policy. Should any change impact your privacy or patients’ privacy in a material respect, we will send you a notice by email (at the email address provided for your registration purposes) prior to implementing such change. If you do not agree to abide by these terms, do not use or access (or continue to use or access) the Site.

 

  1. What Personal Information is Collected

 

    1. Information Collection and Use

Privacy laws in Canada generally define “personal information” as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. “Personal health information” includes personal information relating to the physical or mental health of an individual. Service Provider collects personal information from you on the Profile and Registration pages (“Profile pages”) on our site. Service Provider also collects personal information and personal health information that you provide about your patients (“Patient Information”). Service Provider will only disclose such information in accordance with this Privacy Policy.

 

b. Third Party Email Addresses
You may be given the option to provide email addresses of your patients or colleagues to the Service Provider for the purposes of providing them access to the Site. If you choose to provide this information, Service Provider will send an email to such persons inviting them to join the Site. Service Provider will not solicit, spam or otherwise email any email addresses so provided. This platform is compliant with CASL – the Canadian Anti Spam Legislation.

 

c. Unauthorized Users

In order to use the Site, you must:

 

(a) be validly licensed and authorized to provide healthcare and/or caregiving services in Ontario, which includes, but is not limited to, physicians, nurses, nurse practitioners, and administrative employees or authorized agents affiliated with a licensed healthcare provider;

(b) be a registered member participant of https://InMyTeam.ca, and

(c) be a resident in either one of the 10 Canadian Provinces or 3 Canadian Territories.

 

Prior to using this Service, you must provide the Service with valid confirmation of (a) & (c), above, including all of the following: (i) your name; (ii) your mailing and email address; (iii) jurisdictions of licensure (physicians only), (iv) medical license number (physicians only); and (v) such other confirmatory information as may be required. By submitting this information to the Service, you hereby certify all assertions made under this Section and agree that you authorize the Service to confirm the veracity of such information.

 

  1. How Personal Information is Used

 

    1. Use of Personal Information

The Service Provider does collect personal information about you as well as Patient Information for the purposes of the Site. The Patient Information you provide may include (but not limited to): patient name, gender, contact, phone number, fax, email address, mailing address, selected insurance information, prescription information, weight, test results, relevant previous therapies and medical diagnosis. The Patient Information collected by the Service Provider is provided to the Insurance Company in order for the Insurance Company to assess the patient’s eligibility of insurance coverage or assess in an insurance claim. Such information is further used by Service Provider to assist in administering the Site, including through communicating with third parties such as insurance companies and government agencies (in order to facilitate coverage) and licensing bodies (in order to validate User credentials). In connection with the foregoing activities, Service Provider may be required to share your statistical or aggregated data related to your personal information as well as the Patient Information with third parties. Such statistical or aggregated data does not and will not directly or indirectly identify a specific person.

 

    1. Sale of Assets, Merger, Acquisition, Bankruptcy

Information collected from you may be transferred to a third party, in accordance with applicable law, as a result of a sale or acquisition, merger or bankruptcy involving the Service Provider.

 

 

  1. How Information May be Shared
    1. Sharing

The Service Provider may share information in the manner described above in the section entitled “How Personal Information is Used”.

 

    1. Consulting

The Service Provider may partner or contract with another party for such party to provide specific services for the purposes of the Site. In such a case, we may be required to share personal information and Patient Information you have provided to us that is necessary for the third party to provide the services. Any such third party shall be contractually obligated to keep personal information and personal health information confidential and to use it only for the purposes for which we disclose it to them.

    1. Spam

The Service Provider maintains a strict “No-Spam” policy, which means that Service Provider will not sell, rent or otherwise provide your email address to a third party without Your consent, except as otherwise provided herein.

 

    1. Legal Requests

Service Provider cooperates with law enforcement, regulatory authorities and supervisory authorities as well as affected third parties in order to comply with legal and regulatory requirements, requests and inquiries and protect and enforce third party rights, including intellectual property rights, privacy laws and regulation and laws relating to fraud. Therefore, in response to a request or demand by any of the foregoing relating to a legal, supervisory or regulatory investigation, alleged unlawful activity or other activity that may expose Service Provider or you to legal liability, Service Provider may (and you authorize Service Provider to) disclose your personal data and such information about or provided by you (including Patient Information) as Service Provider, in its sole discretion, believes necessary or appropriate.

We may also disclose personal information and Patient Information provided by you to enforce or apply our terms of use and other agreements we have with you.

 

  1. How we Protect Your Personal Information

 

    1. Confidentiality, Retention and Security

The Service Provider takes all necessary precautions to protect your and your patients’ personal information. All data is stored on secure servers based in Canada. When the Service Provider requests that you enter sensitive information, including any Patient Information, that information is encrypted using Secure Sockets Layer (SSL) software, AES encryption, or other security protocol, which encrypts the information you input. Also, no administrator at Service Provider will have knowledge of your password. We remind you that it is important for you to protect against unauthorized access to your password and to your computer. Be sure to log off from the Site when you have finished using a shared computer. Within Service Provider, access to personal information is limited to trained employees who Service Provider reasonably believes need such information to provide the Service. However, except to the extent required by law and any agreements binding Service Provider, Service Provider is not responsible for the confidentiality, security or distribution or disclosure of personal information (including Patient Information) by our partners and clients (including Insurance Companies) to whom Service Provider transfers information in connection with the provision, administration and operation of the Service.

 

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect the personal information and Patient Information you provide, we cannot guarantee the security of the information transmitted to the Site. Any transmission of such information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

    1. Links

The Site may contain links to third-party sites. Such sites are not under the control of Service Provider. Please be aware that Service Provider is not responsible for the privacy practices or policies of such third-party sites. Service Provider encourages you to be aware when you leave the Site and to read the privacy policies of each other site to which you connect to ensure you understand how it collects and uses personal information and that your actions are in compliance with applicable law (including laws governing the collection, use and disclosure of personal information and personal health information). If you decide to access any third-party site linked to the Site, you do so entirely at your own risk.

 

    1. No Liability for Certain Events

The Service Provider will not be liable for the transfer of any personal information resulting from the corruption of storage media, power failures, natural phenomena, acts of God, riots, acts of vandalism, sabotage, terrorism or any other event beyond Service Provider’s control.

 

  1. How we Correct Errors

    1.  Correction/Updating/ Removing Personal Information

If your personal information changes, or if you or any of your patients no longer desire and/or consent to use the Site, you can update your profile on the Site and/or you or your patients, as the case may be, may advise us by email to privacy (at) InMyTeam (dot) com[1]  that you or they, as the case may be, no longer wish to be included in the Site. Upon being advised of the foregoing, Service Provider will correct, update or remove your personal information or that of your patient(s), as applicable, from the Site.

The Service Provider may email you to provide you with information about the Site and to assist you in resolving issues relating to your use thereof.
